General Terms and Conditions (GTC)

1. Scope

These General Terms and Conditions (“GTC”) apply to all orders placed via the online shop character-gems.art.

2. Offers and Products

We primarily sell:

Gemstones
High-quality macro art photography (e.g., aluminum dibond, acrylic, custom-made products)

Color deviations may occur due to technical reasons.
We reserve the right to make product and price changes.

Complimentary items (e.g., USB sticks) may be included with certain products if explicitly stated. There is no entitlement to such items.

3. Orders and Contract Formation

By completing the checkout process, the customer submits a binding offer to purchase.
The purchase agreement is only concluded once we explicitly confirm the order via email.

We reserve the right to reject orders without providing reasons.

4. Prices and Payment Terms

All prices are stated in Swiss Francs (CHF).
Unless otherwise specified, shipping costs are not included.

The customer is responsible for providing accurate and up-to-date information (especially payment and contact details).

5. Shipping and Delivery

Delivery times indicated are non-binding estimates.
To the extent permitted by law, the risk transfers to the customer upon handover of the goods to the shipping carrier.

6. Voluntary Return Policy

As Swiss law does not provide a statutory right of withdrawal, character-gems.art grants a voluntary, limited return policy.

6.1 Gemstones

Return possible within 7 days of receipt
Only in unused, undamaged, and unaltered original condition
Original packaging must be included
Return shipping costs are borne by the customer

Refunds are issued only after inspection of the goods with regard to condition and authenticity.

6.2 Art Prints (Alu-Dibond, Acrylic, Custom Products)

These products are individually manufactured and are therefore generally excluded from return.

Exception: demonstrable transport damage (must be reported within 48 hours with photos).
In such a case, a replacement or refund will be provided.

6.3 Digital Content

Digital products are not eligible for return once the download has begun.

6.4 Complimentary Items

Free additions are excluded from return and exchange.

6.5 Return Process

All returns must be registered in advance via email:

Returns without prior registration will not be accepted
The return address will be provided individually after contact

The business address stated in the imprint is used exclusively for administrative purposes and is not intended for returns.

7. Retention of Title

Goods remain the property of character-gems.art until full payment has been received.

8. Technical Platform (Shopify)

This online shop is operated using Shopify.
Shopify provides the technical infrastructure only and is not a contractual party.

9. Intellectual Property

All content (images, texts, designs, logos) is protected by copyright.
Any use without explicit written permission is prohibited.

10. Data Protection

Personal data is processed in accordance with our Privacy Policy.
We comply with the requirements of the revised Swiss Data Protection Act (revDSG).

11. Liability

We are liable exclusively for damages caused by intentional or grossly negligent conduct.
To the extent permitted by law, liability for slight negligence and indirect damages is excluded.
